Swimming Masters Terms

Please read our general terms and conditions

Acceptance of terms and conditions:

  • Acceptance of our terms and conditions is considered an agreement between Swimming Masters and you, the client, when lessons are booked, agreed and confirmation of payment is made.

  • Violation and/or infringement of these terms and conditions may result in termination of any lessons and Swimming Masters will not be obliged to provide refunds or reimbursement.

  • Swimming Masters reserves the right to modify these terms and conditions at any time.

Bookings and Payments:

  • Swimming lessons are booked in monthly blocks and an initial assessment is mandatory before monthly bookings can occur.

  • Payment will be made to Swimming Masters' bank account via standing order on the 1st of each month..

  • We do not accept payment by cash and payment will not be accepted at any swimming pools and/or venues used by Swimming Masters.

  • Payment must be agreed by Swimming Masters and made prior to the commencement of an assessment and monthly bookings.​

  • Swimming Masters reserves the right to refuse a prospective clients enrolment including re-enrolment, without reason given.

  • Swimming Masters will do all we can to accommodate your preferences but cannot guarantee that this can be fulfilled.  We are more than confident, however, that all of our teachers can provide the quality of tuition that we expect and you deserve.

Cancellations and Rescheduling:

  • Swimming Masters will give you the opportunity to request credit back or rescheduling for one, one to one lesson during a monthly block -  permitting at least 48 hours notice via email has been given before a lesson occurs.

  • Swimming Masters will give you the opportunity to cancel an assessment booking and/or any one-off booking -  permitting at least 48 hours notice via email has been given before a one to one lesson occurs.

  • Swimming Masters will accept notification via email for planned cancellations for one month in advance of the current monthly block.​

  • In the event of tardiness or late arrival, lessons will not be extended nor a refund or reimbursement given.

  • If we determine that there is insufficient support due to, but not restricted to, pool closures and/or illness for a lesson we reserve the right to cancel or reschedule  when necessary. We will give you as much notice as possible in any such event.

  • If a Swimming Masters officer, instructor or representative deems the swimmer unfit to participate on the day for any of the following - but are not restricted to; sickness, injury or intoxication, then we hold the right to immediately cancel that lesson and any further lessons without refund or reimbursement.

 

  • Once a booking has been confirmed you will not have the right to change days, dates, times or teachers set when the booking was made. Swimming Masters, at our own discretion, will reschedule if possible but cannot guarantee this will occur.

  • Once a request for either a reimbursement or rescheduling has been made, this cannot be changed, and is at the discretion of an executive offer of Swimming Masters.

  • When your rescheduling or reimbursement request has been made, this must be redeemed within a maximum of two months, any change to this, is at the direction of an executive offer of Swimming Masters.

Medical

  • It is your responsibility to ensure that you, the client, ensure the swimmer is medically safe to swim. We will not be liable for any accidents or injuries arising from swimming with us that relate to the swimmer’s individual medical conditions.

 

  • You must declare to us in writing, by email, all medical conditions affecting the swimmer, regardless of severity. We will in our absolute discretion decide whether such medical conditions will restrict your engagement in lessons and we will notify you of our decision.

Code of Conduct:

  • Swimming Masters holds a zero-tolerance policy regarding aggressive, abusive and/or inappropriate behaviour towards individuals you may come into contact with during your experience with us.

  • Any such behavior towards staff of Swimming Masters, staff of/and individuals within the vicinity of venues used by Swimming Masters, but not restricted to, may result in cancellation without refund or reimbursement and the necessary authorities may be informed.

 

  • In the event that you, your child or your party causes harm, damage, loss or injury to any other person or property during your lessons and/or within a venue used by Swimming Masters, you agree that we will not be held accountable or liable and you will reimburse us for all claims, losses, damages, expenses (including legal fees), and any other liability suffered by us because of such harm, damage, loss or injury caused by you or your child.

 

  • You will ensure that you, your children and your party will follow the general swimming pool rules set by Swimming Masters and venues used by Swimming Masters.

 

Some general pool rules are as follows, but are not restricted to:

  • Swimmers must all shower before they enter the water.

  • Shoes must be removed before entering the poolside or overshoes worn.

  • Swimmers should wear appropriate swim wear; goggles, swimsuits, swimming shorts and/or jammers.

  • You, your party and the swimmer(s) must safely leave the pool as soon as your lesson has finished.

  • No recording equipment of any kind will be permitted on and/or around poolside. This includes, but is not restricted to; mobiles phones, cameras, tablets, iPads etc.

  • Parents and/or guardians of swimmers are responsible in ensuring that swimmers toiletry needs are met, prior to and during lessons, if the swimmer is unable to carry out these responsibilities unattended.

  • Parents and/or guardians must ensure they are within immediate reach, in such events, and Swimming Masters will not be obliged to refund  time or payment for such reasons.

Usage of leisure facilities e.g. pool, gym and parking

  • Clients, swimmers and their party will obey rules set by venues and facilities used by Swimming Masters.

  • Clients, swimmers and their party will not use venues and facilities outwith prior authorisation from the venues and facilities notable authority e.g. using the swimming pool or parking areas​

  • If you park outwith one of our venues during your lesson for, but not restricted to, convenience, a car park is full or you cannot access the car park we will not provide reimbursement for any related charges or costs.

 

  • Swimming Masters and venues used by Swimming Masters have the right to deem parents and/or guardians, swimmers and those within their party as a concern to safety. This may result in removal from the premises and cancellation of lessons without refund or reimbursement.

 

  • Swimming Masters will not be responsible for any injury/accident caused as a result of clients, swimmers and/or their party disobeying rules set by Swimming Masters or venues and facilities used by Swimming Masters and acting inappropriately within the venue’s vicinity.

Communication and Correspondence

  • Communication with Swimming Masters regarding bookings, cancellations, complaints or other related/relevant issues will be conducted through an executive officer of Swimming Masters, not swimming instructors and/or staff of venues used by Swimming Masters.

  • If you require to contact or speak with an executive officer of Swimming Masters please contact us through contact details listed on our website.

  • Issues that require you to provide written declaration or proof - highlighted in these terms and conditions but not restricted to, will be your responsibility.

  • Contact details of the client and swimmer(s), we require, will be your responsibility to provide before lessons can occur.

Collection of children

  • Children under the age of 16 must be collected by an adult known to Swimming Masters immediately after a lesson completion.

  • Swimming Masters will always require clarification on who will be collecting children from lessons. If the person collecting the child is unknown to Swimming Masters notice of this must be given, via email, at least 24 hours prior to a lesson – anything under is subject to cancellation of lessons without refund.

  • In the circumstance someone unknown to Swimming Masters attempts to collect a child under the age of 16 during or following the completion of a lesson the relevant local authorities may be contacted.

Governing Law

  • These terms and conditions shall be governed by and construed in accordance with Scots law and are subject to jurisdiction to the Scottish courts.
